Terms of Use

1. Adult users only

You must be at least 18 years old and legally able to agree to these Terms. The Service is intended for parents, legal guardians, caregivers, and educators—not for independent use by children. An adult must supervise any activity performed with a child.

2. Educational purpose

The Service provides general educational information, activities, checklists, and organizational tools. It does not provide medical, developmental, psychological, therapeutic, special-education, or legal services. It does not diagnose a condition, determine eligibility for services, or guarantee kindergarten readiness or any other result.

The Educational and Medical Disclaimer is part of these Terms.

3. Local app data

Readiness answers, activity progress, and preferences are stored in your browser and are not backed up or synchronized by us. Clearing browser storage, using private browsing, changing devices, or resetting the Service may permanently remove that information.

You are responsible for any exported files and for protecting information stored on a shared device.

4. Permission to use materials

We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for lawful personal, family, or classroom educational purposes.

Unless a resource says otherwise, you may print or download Milestone Pre-K materials for personal, household, or classroom use. You may not resell them, remove ownership notices, publish them as your own, systematically copy the Service, or use its content to create a competing commercial product without prior written permission.

5. Acceptable use

You may not:

• Use the Service unlawfully or to harm another person;
• Attempt to bypass security or interfere with operation of the Service;
• Introduce malware, automated scraping, or excessive automated requests;
• Misrepresent affiliation with Milestone Pre-K; or
• Submit or transmit information that violates another person’s privacy or intellectual-property rights.

6. Ownership

The Service, including its original design, text, graphics, code, and branding, is owned by Samuel Salazar or used with permission and is protected by applicable law. Third-party names and materials remain the property of their respective owners.

7. Third-party resources

The Service may link to third-party resources, including CDC materials. We do not control those sites and are not responsible for their availability, accuracy, security, or practices. Links are provided for convenience and do not imply sponsorship, approval, or affiliation.

8. Availability and changes

We may change, suspend, or discontinue any part of the Service. We do not promise uninterrupted availability or that browser-stored information will always remain available. We may update content as guidance and resources change.

9. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” MILESTONE PRE-K AND SAMUEL SALAZAR DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

Some jurisdictions do not allow certain warranty exclusions, so part of this section may not apply to you.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MILESTONE PRE-K AND SAMUEL SALAZAR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, ARISING FROM OR RELATED TO THE SERVICE. TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED US $100.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain limitations, so part of this section may not apply to you.

11. Governing law and disputes

These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law principles. Any dispute not resolved informally must be brought in a state or federal court with jurisdiction in Oklahoma, and you consent to jurisdiction and venue there. This section does not remove consumer protections that cannot legally be waived where you live.

Before filing a claim, please contact us and allow a reasonable opportunity to resolve the issue informally.

12. General terms

If any provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and applicable disclaimers, form the entire agreement concerning the Service.

13. Changes and contact

We may update these Terms by posting a revised version with a new “Last updated” date. Continued use after an update means you accept the revised Terms to the extent permitted by law.
